Terms and Conditions of Service
By purchasing our services you agree to the following terms and conditions:
The following terms and conditions are applicable to all web design,
web hosting and related services provided by Web Site Solutions.
Any additional terms and conditions that may arise, will be specified to you in detail,
in writing.
1. Authorization. When you engage Web Site Solutions Web Design for the specific purpose of developing and/or improving a
web site, you authorize us to access your hosting account, and authorize your web hosting service to provide us with "write permission" for the your web pages, cgi-bin directories and any other directories or programs which need to be accessed for this project including
MySQL databases. You also authorize us to publicize the completed web site in
our portfolio, to search engines and other web directories and indexes.
2. Web Hosting. Please understand that any web hosting requires a separate contract
from the design and development contract. Most of our clients choose to use our
complete range of services, as an all inclusive solution for their online
business. If you
use another host, you agree to select a web hosting service which allows us full access to the
web site and a cgi-bin directory via FTP and telnet. You further understand that if the web hosting service's operating system is not
Windows or Linux compatible, or if there are limitations in place that will not allow some standard software to work, providing a substitute may
include additional charges.
3. Maintenance and Updates. Updates to content in your web site are included for
three (3) months at no additional cost with all new web plans selected. This
covers all changes to content (text), please provide in electronic format. It does not include changes to the site design,
changes to images, or installing additional pages, modules, plugins or other
functionality. Maintenance, for all clients without a plan, will be billed at our normal hourly rate.
4. Content. You are responsible for writing and providing the content for your web site, unless otherwise specified or agreed
upon in writing.
5. Software. In an effort to save our clients money, we often recommend Open Source software so the client will not be required to pay licensing fees for the use of the program. If you opt to use a licensed software program that requires licensing fees, you are solely responsible for the payment of
those fees. Software programs have standard functionality and are customized by us during the design process to meet your needs. Any additional functionality beyond the standard parameters built into the software is dependent upon the availability of add-on modules. Modifying any software program or installing additional modules beyond that specified in the design estimate
or quote or after the site is completed will be billed at our normal hourly rate.
6. Modifications to Your Site. If you make any changes to your web site yourself, or use a third party to make changes to your
web site, we will not be responsible for the look or functionality of your site. Corrections to your
web site after changes have been made by you or a third party will be billed at our normal hourly rate.
Monthly, quarterly and annual web site maintenance plans are also available.
7. Contacting Us. If you contact us by telephone for any reason other than a technical defect in your
web site or any programs or scripts installed in your site beyond the
three-month maintenance period, you will be billed for the time spent on the call at our normal hourly
rate of $12.00. If you have questions regarding updates or changes to your site please contact us via email
or submit a support ticket online and we will
promptly provide an answer.
8. Completion. In the quote provided for your project we provide the estimate time it will take to be completed. This time frame may be longer if you fail to provide content in a timely
fashion.
9. Payments. An initial deposit (normally 50% of the estimated total cost) is due upon execution of an agreement. Final payment is due on
project completion
or at the end of the project timeframe, unless otherwise agreed upon in
writing. If the
web site is not completed within the time frame specified because you have failed to provide content
or information as required, final payment will be due at the expiration of the
project time frame provided. Advertising the pages and submission to search engines occurs only after the final payment is
made and project is complete.
10. Payment of Fees. Fees are due and payable as detailed in the project estimate. In the event the client has not secured web space on a web hosting service by the time the web pages are completed, the web pages may be delivered to the client on CD,
flash drive or as agreed upon, in writing. All payments will be made in US funds by approved electronic transaction, unless otherwise agreed
upon in writing.
11. Hourly Rates. Our normal hourly rates range from $12.00 to $45.00 per
hour, depending on the resources required. There is a fifteen (15) minute minimum for any updates or modifications to your site
(does not include the
three month maintenance period) or for any telephone consultations as specified above.
12. Assignment of Project. While we prefer to perform all work in-house,
we do reserve the right to assign subcontractors to your project to ensure proper function and on-time completion.
We do not outsource our clients' projects or customer services to companies in other countries.
We hire locally.
13. Copyrights and Trademarks. You represent to us and unconditionally guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to us for inclusion in your web pages are owned by
you, or that the you have permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend us and our subcontractors from any claim or suit arising from the use of such elements furnished by
you.
14. Laws Affecting Electronic Commerce. From time to time governments enact laws and levy taxes and tariffs affecting Internet electronic commerce. You agree that you are solely responsible for complying with such laws, taxes, and tariffs, and will hold harmless, protect, and defend us and our subcontractors from any claim, suit, penalty, tax, or tariff arising from the your exercise of Internet electronic commerce.
15. Payment by Check. We typically accept payment via credit card but will however, accept payment by check only if agreed to beforehand. Additionally, because of extended check clearance periods, we no longer will accept any check drawn by a third party provider, as is the case with online check payment services. Checks must be made directly upon the bank and account to which the funds are drawn.
16. Late Payment Penalties. In order for us to remain in business, payments for services
(beyond the initial design fees for a new web site plan) must be made promptly and are due within
10 days of the date of invoice or as otherwise agreed upon or stated above. Delinquent bills will be assessed a $25
late charge if payment is not received within 10 days of the invoice date. If an amount remains delinquent 30 days after its due date, an additional 5% penalty will be added for each month of delinquency. We reserve the right to remove web pages from viewing on the Internet until final payment is made. In case collection proves necessary, you agree to pay all fees incurred by that process.

Technical Support
- From time to time technical issues may arise where your
web site might not function as intended. We will correct any technical issues in the functionality of our servers at no cost. We are available 24x7x365. Submit
your technical support request via email or submit a support ticket online for
the fastest response time. Your satisfaction is important to us and Alliance Web Site Solutions will
honor all support requests promptly.

- Hosting Renewals
- In order to ensure uninterrupted service to your
web site, the
hosting service
contract will renew unless cancelled by the site owner. Alliance
Web Site Solutions requests that hosting cancellations be made via email or
postal mail at least 2 weeks prior to the date of renewal. Alliance Web Site
Solutions will acknowledge the cancellation notice in writing, within 24 hours of receipt.
Your satisfaction is important to us and Alliance Web Site Solutions will
honor all requests promptly.

- Acceptable Use Policy
- Alliance Web Site Solutions reserves the right to refuse service to any
site at our sole discretion. Although we do not believe in censorship,
Alliance Web Site Solutions does not allow the following types of sites:

Any content which is not legal in the United States

Web sites containing explicit pornographic material

Racist or hate-related web sites

"Warez" sites, including but not limited to any
copyrighted software or music files

Sites which provide methods for circumventing copy protection

"cracks", key codes, serial numbers, decoder chips,
etc...
are also not permitted

- Unsolicited Email (spam) and Bulk Email
- Alliance Web Site Solutions will not host
web sites which are advertised
through unsolicited email, excessive newsgroup cross posting, or off-topic
newsgroup posts. What is considered spam is determined at the sole discretion
of Alliance Web Site Solutions. We will make every effort to work with our
customers to insure that legitimate web sites are not shut down due to what may
be wrongly interpreted as unsolicited mail. Although we are first and foremost
an advocate of our customers, sites in flagrant violation of this policy will
be shutdown without a refund of any kind. In addition, to protect the quality
of service for all of our customers, any bulk emailing that adversely affects
the performance of our shared mail servers will be either discontinued or
moved, pending customer approval, to one of our list server or dedicated
server plans.

- Bandwidth and Overages
- Each hosting plan is allocated a specific amount of network and system
resources which is clearly specified on the Alliance Web Site Solutions web
site for each hosting plan. We realize that from time to time, customers may have unanticipated
circumstances which cause their web sites to use more bandwidth, disk space, or
other resources than they have been allocated with their plan. In extreme
cases, such overages may result in additional charges or the request to
upgrade your service to a more suitable plan. Alliance Web Site Solutions will
make every effort to contact you to prevent any unexpected charges or service
interruptions. If the resources required by your web site negatively impact
other customers in our shared hosting environment, we may take steps,
including possible temporary suspension of service, to restore normal server
operations. Under all circumstances, suspension of service is an absolute last
resort and we will make every effort to work with our customers to insure
continuous and trouble-free service.
Refunds
- Web Hosting Refunds
- Alliance Web Site Solutions web hosting services carry an unconditional 30
day satisfaction guarantee. If you are dissatisfied for any reason within the
first 30 days of service, please contact us by email for a full and
immediate refund. If you wish to retain your domain name, the cost of your
domain name will be deducted from your refund.

- Web Development and Design Refunds
- Alliance Web Site Solutions requires a deposit for
acceptance of all web projects. Once we accept a project, the work is scheduled for
production according to the mutually agreed upon timeframe. Once a payment
is processed, we begin the development and/or design phase, unless other arrangements have been requested by the client in
writing. Deposits on projects are non-refundable. The balance is due in upon completion of the
project or prior to publishing.
Alliance Web Site
Solutions reserves the right to decide whether a refund is applicable if requested by the Client for any reason. A refund is not guaranteed by Alliance Web Site Solutions, but possible providing Alliance Web Site Solutions decides upon this option.
If your account has been cancelled, due to a breach of the terms and conditions on your part, you will not be eligible for a refund. Phone requests will not constitute acceptance of
a cancellation.
Cancellation requests and confirmations must be in writing.

response to reported copyright infringement and intellectual property
violations are governed by the Digital Millennium Copyright Act (DMCA).

Revisions to Terms and Conditions
- Alliance Web Site Solutions reserves the right to revise the content of this site
including the Terms and Conditions by updating the information that is posted. You are bound by any such revisions and should therefore periodically visit this page to review the current Terms and Conditions to which you are bound.
